Dallin Oaks was born in Provo, Utah, on August 12, 1932, to Stella (née Harris) and Lloyd E. Oaks. He is a 2nd great-grandnephew of Martin Harris, one of the three Book of Mormon witnesses, via his mother. In honor of Utah artist Cyrus Dallin, he was given the name Dallin. Oaks received a full-tuition National Honor Scholarship to the University of Chicago Law School, where he served as editor-in-chief of the University of Chicago Law Review during his third year. - Oaks spent a year as a clerk to Chief Justice Earl Warren of the United States Supreme Court after graduating from law school in 1957. Following his clerkship, he worked at the Chicago legal firm Kirkland & Ellis, focusing on business litigation.

When Oaks first started at Kirkland & Ellis, he worked under Robert Bork, but he soon rose through the ranks to become one of the firm’s main attorneys.
- Oaks was appointed as a judge of the Utah Supreme Court by Utah governor Scott M. Matheson on January 1, 1981, after graduating from BYU.
